On March 3, 2026, the Hague Division of the Unified Patent Court (UPC) recently issued a final judgment in the patent infringement case brought by Advanced Brain Monitoring (hereinafter referred to as “ABM”) against Philips.

The AI copyright dispute originated with computer scientist Stephen Thaler, who sought copyright registration for a visual artwork titled A Recent Entrance to Paradise, created by his self-developed AI system DABUS. Thaler listed the AI as the author in the application.

According to the ruling, the ITC upheld its prior infringement determination and issued a Limited Exclusion Order and Cease and Desist Order against Insta360. These orders prohibit Insta360 from continuing to import, sell, or promote the infringing products within the United States. Both orders will take effect after completion of the Presidential review process.

Recently, in its patent dispute with InterDigital, Amazon was found by the Mannheim Regional Division of the Unified Patent Court (UPC) to have violated an anti-interference injunction (AII)*. The company made a court commitment during the hearing, thereby avoiding a potential fine of up to 50 million euros (approximately 404 million yuan).

Nokia's approach to proposing interim licensing mirrors Huawei's strategy in securing a successful interim license declaration against TP-Link in the UK High Court. When patent holders proactively accept court-determined rates, licensees who previously actively sought UK judicial relief may hesitate. For them, interim licensing shifts from leverage against Nokia to a potential court ruling that could determine their global royalty rates.

According to the public complaint, Amazon's Prime Video streaming service, CloudFront content delivery network service, and Fire series terminal devices implement the patented technical solutions in their content caching, request routing, edge node management, and data distribution mechanisms. These implementations fall within the scope of the relevant patent claims. Therefore, InterDigital requests the court to find Amazon liable for patent infringement and order it to bear corresponding damages.

Recently, Bayer Healthcare (hereinafter referred to as “Bayer”) filed a lawsuit in the U.S. District Court for the Southern District of New York against Johnson & Johnson (hereinafter referred to as “Johnson & Johnson”) and its subsidiary Janssen Biotech. In the lawsuit, Bayer alleges that Johnson & Johnson engaged in false advertising using research data that does not meet FDA standards. Bayer is seeking an immediate court order to halt the relevant advertising and is pursuing damages.

On February 20, 2026, Ericsson initiated standard essential patent (SEP) litigation against Verifone at the Mannheim and The Hague divisions of the Unified Patent Court (UPC). Both cases revolve around standard essential patents in the cellular communications field.

The order issued clearly delineates the boundaries for seeking injunctions and FRAND relief in the UK, establishing red lines for UPC enforcement. Under this order, Amazon must withdraw or amend its injunction requests filed in the UK, or risk fines of up to €50 million.

This ruling temporarily blocks Samsung's lawsuit, initiated in February 2025, at the jurisdictional stage. This lawsuit is one of a series filed by Samsung Electronics and its affiliates against ZTE for violating fair, reasonable, and non-discriminatory (FRAND) licensing commitments. Concurrent cases are also being heard in the UK and Germany. Samsung alleges ZTE engaged in monopolistic practices, breached contracts, and violated California state law regarding 4G and 5G standard-essential patent licensing. The complaint also notes that ZTE pleaded guilty in 2017 to violating U.S. sanctions against Iran and North Korea, resulting in an $1.19 billion fine. Additionally, some of its products were banned from sale in the U.S. in 2022 by the Federal Communications Commission on national security grounds.
