This lawsuit expands the legal debate surrounding copyright issues in AI training data. Currently, the Second Circuit Court of Appeals is reviewing a case focusing on whether bypassing technical protection measures that prevent downloading constitutes illegal circumvention under Section 1201 of the DMCA.

This preliminary injunction application has drawn significant attention to the Munich court's stance. The court's Seventh Civil Division previously supported an injunction request in an SEP-related case on November 20, 2025. In the ETRI case, the court must assess whether Meta's potential FRAND (Fair, Reasonable, and Non-Discriminatory) defense requires in-depth examination during preliminary injunction proceedings.

This move directly relates to two patent injunctions previously obtained by InterDigital in Munich courts.

The patent in question is European Patent EP 3797535, originally held by BlackBerry and later transferred to Malikie. This patent pertains to 5G technology related to emergency communication services. Malikie alleges that Xiaomi implemented this patented technology in its smartphones without authorization, constituting infringement. Consequently, Malikie has petitioned the UPC to order Xiaomi to cease infringement and bear corresponding legal liability.

On January 19, 2026, the Mannheim Regional Division of the Unified Patent Court (UPC) issued a new ruling in the standard-essential patent (SEP) infringement dispute between Huawei Technologies Co., Ltd. (hereinafter referred to as “Huawei”) and Finnish mobile phone manufacturer HMD Global Oy (hereinafter referred to as “HMD”). The ruling explicitly places all information related to the parties' FRAND licensing negotiations under a unified confidentiality regime.

This lawsuit further extends Transsion's growing list of global patent disputes. Previously, Transsion faced litigation from companies including Ericsson and InterDigital in multiple jurisdictions over standard essential patents (SEPs). Concurrently, Transsion reached settlements or agreements in 2025 with rights holders such as Qualcomm, Philips, Nokia, Huawei, and the Electronics and Telecommunications Research Institute (ETRI) regarding relevant patent licenses.

Recently, Warner Bros. Discovery (WBD) applied to a UK court to accelerate proceedings in its patent dispute with Nokia, citing “commercial pressure” and requesting a prompt judicial ruling on the matter.

Recently, John Squires, Commissioner of the United States Patent and Trademark Office (USPTO), issued an order terminating the inter partes review proceedings initiated by Chinese chipmaker Yangtze Memory Technologies Co., Ltd. (hereinafter referred to as Yangtze Memory) against two patents held by Micron Technology, Inc. (hereinafter referred to as Micron).

The lawsuit was filed by Longitude in November 2023, with the patents in question primarily concerning semiconductor devices and pixel electrode configuration methods in liquid crystal display technology. The complaint alleged that display screens used by BOE in products for companies like HP infringed these patents, with the underlying technology originally sourced from Japan's Seiko Epson.

It will issue a limited number of “Accelerated Review Certificates” to eligible U.S. entities that make technical contributions to standard-setting activities or engage meaningfully in other ways. Certificate holders may use these to expedite patent application reviews at the USPTO or accelerate proceedings before the Patent Trial and Appeal Board (PTAB).
